Welcome to Luma HRT. These Terms of Service ("Terms") govern your access to and use of the Luma HRT website, telehealth platform, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By creating an account, completing an assessment, scheduling a consultation, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. We reserve the right to update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

2. Description of Services

Luma HRT is a telehealth platform that connects patients with licensed healthcare providers who specialize in hormone replacement therapy (HRT). Our Services include:

• Online health assessments and symptom evaluations
• Telehealth video consultations with licensed physicians
• Personalized bioidentical hormone therapy prescriptions (when medically appropriate)
• Prescription fulfillment and direct-to-patient medication delivery
• Ongoing patient support and follow-up care

All medical decisions, including whether to prescribe medication, are made solely by the treating physician based on their independent medical judgment. Luma HRT does not guarantee that any particular treatment will be prescribed.

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Be a resident of the United States
• Be located in a state where Luma HRT's telehealth services are available
• Provide accurate, complete, and truthful health information
• Have the legal capacity to enter into a binding agreement

We reserve the right to refuse or discontinue service to anyone at our discretion, including if we determine that a patient is not a suitable candidate for hormone replacement therapy.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. You must provide accurate and complete information when creating your account and keep your information up to date.

5. Billing and Payment

By subscribing to our Services, you agree to the following pricing:

• Starter Kit: $49 for your first month, which includes your initial telehealth consultation, personalized prescription (if prescribed), first month of medication, and free shipping
• Monthly Subscription: $89 per month thereafter, which includes ongoing medication, provider access, and continued care

All fees are charged in U.S. dollars. Your subscription will automatically renew each month unless cancelled. Payment is due at the time of service or subscription renewal. We accept major credit and debit cards.

Prices are subject to change with reasonable advance notice. Any price changes will apply to billing cycles beginning after the effective date of the change.

6. Cancellation and Refunds

You may cancel your subscription at any time through your patient portal or by contacting our care team at support@lumahrt.com. Upon cancellation:

• Your subscription will remain active through the end of your current billing period
• No further charges will be applied after cancellation takes effect
• There are no cancellation fees or long-term commitments

We offer a 30-day satisfaction guarantee for new patients. If you are not satisfied with your experience within the first 30 days, contact our care team for a full refund. Refund requests after 30 days will be evaluated on a case-by-case basis.

7. Medical Disclaimer

The information provided through our Services, including our website content, assessments, and educational materials, is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Our online assessments are screening tools and are not a substitute for a professional medical evaluation.

The physician-patient relationship is established only during your telehealth consultation with a licensed provider. All treatment decisions are made by your treating physician. Individual results from hormone replacement therapy vary. The testimonials and results described on our website reflect individual experiences and are not guaranteed outcomes.

If you are experiencing a medical emergency, call 911 or go to your nearest emergency room. Luma HRT does not provide emergency medical services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Luma HRT, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, including but not limited to:

• Any adverse reactions to prescribed medications
• Interruptions or delays in service delivery
• Loss of data or unauthorized access to your account
• Any decisions made based on information provided through the Services

Our total aggregate liability for any claims arising from or related to the Services shall not exceed the total amount you paid to Luma HRT in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Luma HRT and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

10. Intellectual Property

All content on the Luma HRT website and platform, including text, graphics, logos, images, and software, is the property of Luma HRT or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal and health information. By using our Services, you consent to the practices described in the Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from or related to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Delaware. You agree to waive any right to a jury trial or to participate in a class action.

13. Termination

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without cause, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination shall remain in effect.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
